There are two categories of Obstruction of Justice under Alabama Law, What most people think of as Obstruction of Justice is the Obstructing Governmental Operations statute found at AL Code § 13A-10-2 (2023). This definition of obstructing justice is when by means of intimidation, physical force or interference or by any other independently unlawful act,

  • Intentionally obstructs, impairs or hinders the administration of law or other governmental function; or
  • Intentionally prevents a public servant from performing a governmental function.

The second category of Obstruction of Justice is found at AL Code § 13A-8-194 (2023) and is the Obstructing justice using a false identity statute. This is defined as use of identification documents or identifying information of another person or a fictitious person to avoid summons, arrest, prosecution, or to impede a criminal investigation. Obstructing justice using a false identity is a Class C felony.
