Attempted Murder

Under Alabama law a person is guilty of an attempt to commit a crime if, with the intent to commit a specific offense, he does any overt act towards the commission of such offense. Code of Alabama § 13A-4-2 states further It is not a defense that the offense charged to have been attempted was factually or legally impossible of commission, if such offense could have been committed had the attendant circumstances been as the defendant believed them to be. There is not an Attempted Murder Statute. It is the combination of Code of Alabama § 13A-4-2, Attempt, and Alabama Code § 13A-6-2, Murder. An attempt is a Class A felony if the offense attempted is murder.

A person commits the crime of murder under Alabama Code § 13A-6-2 if he or she,

  • with intent to cause the death of another person, he or she causes the death of that person or of another person.
  • Under circumstances showing indifference to human life, he or she recklessly engages in conduct which creates a grave risk of death to a person other than himself or herself, and thereby causes the death of another person.
  • He or she commits or attempts to commit arson in the first degree, burglary in the first or second degree, escape in the first degree, kidnapping in the first degree, rape in the first degree, robbery in any degree, sodomy in the first degree, aggravated child abuse under Section 26-15-3.1, or any other felony clearly dangerous to human life and, in the course of and in furtherance of the crime that he or she is committing or attempting to commit, or in immediate flight therefrom, he or she, or another participant if there be any, causes the death of any person.
  • He or she commits the crime of arson and a qualified governmental or volunteer firefighter or other public safety officer dies while performing his or her duty resulting from the arson.

Thus, there is not a true Attempted Murder Statute. It is the combination of Code of Alabama § 13A-4-2, Attempt, and Alabama Code § 13A-6-2, Murder.
